Review Unit Public Information

If you have received notification from Fiosrú that your complaint is inadmissible, or that an investigation into your complaint is to be discontinued; under the Policing, Security and Community Act, 2024, you have the right to request that that decision is reviewed.  The review will consider whether on the available facts the decision was fair, reasonable and proportionate.

Fiosrú will ensure that the review will be undertaken by members of staff that are independent from the original decision makers.  The review process will be transparent and impartial.

In order to request a review of a decision that your complaint is inadmissible or that an investigation is to be discontinued you must:

  • Be the person who made the initial complaint
  • Request the review within 28 days of being informed of the decision; or provide good reasons why you needed more time to make the request.
  • Provide sufficient information for Fiosrú to link your request to your initial complaint including any case reference number supplied to you
  • Outline why you think the decision that your complaint is inadmissible or the decision to discontinue the investigation of your complaint is not correct.

If you do not provide enough information for us to undertake a review, we may contact you to request further information.

Outcome

Following a review, you will be notified as soon as practicable of the outcome of the review.

If the outcome of the review of a determination that your complaint is inadmissible is to overturn the decision, Fiosrú will then decide whether it is suitable for resolution by An Garda Síochána or warrant an Investigation. 

If the outcome of the review is to overturn the direction to discontinue the investigation, the complaint will be reverted to the Investigations Unit for continued investigation. 

In either an inadmissibility or a discontinuance review, If the decision made by Fiosrú is upheld, Fiosrú will take no further action, and your complaint will be closed.
